1. Acceptance of Terms
By accessing or using TripSet ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms at any time; continued use of the Service constitutes acceptance of the updated terms.
2. Description of Service
TripSet is a travel planning platform that allows users to create, publish, share, and discover travel itineraries. The Service includes AI-assisted ticket import, itinerary cloning, an explorer marketplace, and related features.
3. Account Registration
- —You must provide accurate and complete information when creating an account.
- —You are responsible for maintaining the confidentiality of your account credentials.
- —You must be at least 16 years old to create an account.
- —You are responsible for all activity that occurs under your account.
- —We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Content
- —You retain ownership of the itineraries and content you create on TripSet.
- —By publishing content publicly, you grant TripSet a non-exclusive, royalty-free license to display, distribute, and promote that content on the platform.
- —You must not post content that is illegal, harmful, defamatory, or infringes third-party intellectual property rights.
- —We reserve the right to remove content that violates these Terms without prior notice.
5. Prohibited Uses
- —Scraping, crawling, or automated data collection without prior written consent.
- —Impersonating other users or creating fake accounts.
- —Attempting to gain unauthorized access to the Service or its infrastructure.
- —Using the Service for any unlawful purpose or in violation of any applicable regulations.
- —Posting spam, misleading content, or malicious links.
- —Uploading documents belonging to third parties through the AI import feature — you may only import tickets, bookings, and travel documents that belong to you personally.
- —Publishing itineraries that promote illegal activities, travel to sanctioned regions in violation of applicable law, or content that glorifies harm to persons or animals.
- —Posting sexual, pornographic, or explicitly violent content in any form — including text, photos, or embedded media.
- —Posting content that constitutes hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
- —Including personal URLs, referral links, affiliate links, promo codes, QR codes, or any other promotional material in itinerary text, descriptions, notes, or photos — whether embedded in the image or written in the caption.
- —Uploading photos that contain visible watermarks, brand logos, QR codes, or text overlays serving an advertising or self-promotional purpose.
- —Publishing photos of identifiable individuals without their explicit consent.
- —Fabricating place names, addresses, prices, or other factual information in itinerary content.
5a. Content Moderation
- —TripSet reviews reported content and may remove any content that violates these Terms without prior notice.
- —We aim to review reports within 5 business days. Complex cases (copyright disputes, legal requests) may take longer.
- —If your content is removed, you will be notified by email with a brief reason. You may appeal by contacting legal@tripset.io within 14 days.
- —Repeated violations will result in progressive enforcement: specific content or photo removal, temporary suspension, and permanent account termination.
- —We reserve the right to remove content proactively if it poses an immediate risk of harm, without waiting for a report.
- —The following violations result in immediate and permanent account termination without prior warning or right of appeal: (a) any content that sexually exploits or endangers minors; (b) credible threats of violence against identifiable individuals or groups; (c) automated abuse, mass spam, or coordinated attacks on the platform or its users; (d) any violation committed after a prior account suspension for the same or a similar breach.
6. Marketplace Transactions
- —TripSet is a platform that connects creators of travel itineraries with users who want to clone or buy them. TripSet is not a party to the agreement between a creator and a buyer.
- —Free cloning: users may clone public itineraries that allow cloning. A clone is an editable copy in the user's own account. The user checks and adapts the content before relying on it for travel.
6a. Selling an Itinerary
- —Any creator with a public itinerary can offer it for sale. You set the price in USDT. The minimum price is 13 USDT.
- —Buyers pay in USDT on the BNB Smart Chain (BEP20) or TON network. Payments are processed by NOWPayments.
- —Visitors see day 1 in full and a summary of the other days. The full itinerary opens for a buyer after the payment is confirmed.
- —You must add a payout wallet for each network you want to accept. You are responsible for the address. A payout sent to a wrong address cannot be recovered.
- —TripSet may review your itinerary before the first sale and every later change to its days or description. Until a change is approved, buyers and visitors see the previously approved version. We may reject an itinerary that breaks these Terms or the Creator Terms.
- —The itinerary you sell must be your own work and meet the content standards in the Creator Terms. You must not misrepresent what the itinerary contains.
6b. Fees and Payouts
- —TripSet keeps 10% of every payment received for your itinerary. The rate in force when the buyer starts the purchase applies to that sale. We will announce a change of the rate by email at least 14 days before it applies to new sales.
- —Your payout is the price minus the 10% fee and minus the network fee for sending the payout. The network fee depends on the network and is shown in your sale settings before you turn the sale on.
- —We send the payout to your approved wallet on the same network the buyer paid on, after the payment is final. The time depends on the network and on NOWPayments. If a payout fails, we retry it and may ask you for help. We do not guarantee a payout time.
- —Payments may be delayed, held, or refused under the anti-money-laundering and sanctions rules of NOWPayments and applicable law.
- —Tips and donations that you collect through outside services such as Ko-fi go straight to you. TripSet does not take part in them and charges no fee.
6c. Refunds and Disputes
- —A confirmed payment opens the full itinerary at once, so completed purchases are not refunded. The Refund Policy lists the payments we do refund: an amount above the price, an incomplete payment, and a payment that matches no purchase.
- —Complaints about the quality or accuracy of a paid itinerary go to the creator first. TripSet may step in on a complaint, ask the creator to fix the itinerary, and remove it from sale. TripSet does not refund completed purchases.
- —Buyers keep access to an itinerary they bought after it is unpublished or its sale is turned off. An itinerary with purchases cannot be deleted. It can only be unpublished.
- —If we suspend or ban a creator, new sales of their itineraries stop and payouts that have not been sent are held while we review the case. If you delete your account, payouts for completed sales are still sent and your itineraries with purchases are unpublished.
6d. Liability for Transactions
TripSet's liability for a marketplace transaction is limited to the fees TripSet received on that transaction.
7. Intellectual Property (Platform)
The TripSet name, logo, design, and proprietary software are owned by TripSet and protected by applicable intellectual property laws. You may not use these without our express written permission.
8. Disclaimer of Warranties
- —The Service is provided "as is" without warranties of any kind, express or implied.
- —TripSet does not guarantee the accuracy, completeness, or currentness of any itinerary, whether free or paid. Travel information — including hotel availability, prices, transport schedules, visa requirements, and attraction opening hours — changes frequently and may be outdated.
- —A cloned itinerary is a starting point for planning, not a guaranteed travel plan. Users must independently verify all critical information before travel.
- —TripSet is not liable for any travel disruption, financial loss, injury, or inconvenience arising from reliance on itinerary content created by third-party creators.
- —TripSet reviews paid itineraries for compliance with these Terms. A review does not check the accuracy, completeness, or fitness of the itinerary for any trip.
9. Limitation of Liability
To the maximum extent permitted by applicable law, TripSet shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or any marketplace transaction, including but not limited to lost profits, data loss, travel disruptions, or dissatisfaction with purchased itinerary content.
10. Governing Law and Dispute Resolution
These Terms are governed by applicable international law. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by binding arbitration under the Rules of the International Chamber of Commerce (ICC). The language of arbitration shall be English. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
